Page: 2 3D perception CompactControl and CompactDesigner G00047 User Manual End User License Agreement This 3D perception AS End - User License Agreement ( hereinafter ‘ EULA ’ ) is a legal Agreement between the CUSTOMER and 3D perception AS for this 3D perception AS software product , which includes computer software and associated media and printed materials , and may include ‘ online ’ or electronic documentation ( hereinaf ter ‘ Software Product ’ or S ‘ oftware ’ ) . By installing , copying , or otherwise using the Software Product , the CUSTOMER agrees to be bound by the terms of this EULA . Copyright laws and international copyright treaties , as well as other intellectual property laws and treaties protect the Software Product . The Software Product is licensed , not sold . License Granted All title and copyrights in and to the Software product ( including but not limited to any images , photographs , animations , video , audio , music and text incorporated into the Software Product ) , the accompanying printed materials , and any copies of the Software Product , are owned by 3D perception AS or its suppliers . Copyright laws and international treaty provisions protect the Software Product . Therefore , the CUSTOMER must treat the Software Product like any other copyrighted material , except that the CUSTOMER may either : a ) Make one copy of the Software Product solely for backup or archival purposes or b ) Install the Software Product on a single computer , provided the original is kept solely for backup or archival purposes . The CUSTOMER may not copy the printed materials accompanying the Software Product . In consideration of payment of the License fee , 3D perception AS grants the CUSTOMER a non - exclusive right to use and display the Software Product as long as they comply with the terms of this EULA . Multi - Media Software The CUSTOMER may receive the Software Product in more than one medium . Regardless of the type of or size of medium the CUSTOMER receives , they may use only one medium that is appropriate for a single computer . The CUSTOMER may not use or install the other medium on another computer . The CUSTOMER may not loan , rent , lease , or otherwise transfer the other medium to another user , except as part of the permanent transfer ( as provided above ) of the Software Product . License Rights and Limitations This EULA grants the CUSTOMER the following rights and limitations : � Systems Software The CUSTOMER may install and use one copy of the Software Product on a single computer . If the Software Product includes functionality that enables a single computer to act as a network server , any number of computers or workstations may access or otherwise utilise the basic services of that server , provided that this functionality is detailed in the Scope of Supply . � Storage / Network Use The CUSTOMER may also store or install a copy of the Software Product on a storage device , such as a network server used only to install or run the Software Product on other computers over an internal network . However , the CUSTOMER must acquire and dedicate a license for each separate computer on which the Software Product is installed or run from the storage device . A license for the Software Product may not be shared or used concurrently on different computers . � Limitations on Reverse Engineering , De - compilation , and Disassembly The CUSTOMER may not reverse engineer , de - compile , or disassemble the Software Product , except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation . � Rental The CUSTOMER may not rent or lease the Software Product to any third party . � Software Transfer Provided that the CUSTOMER obtains prior written authorisation by 3D perception AS , they may permanently transfer all of their rights under this EULA provided that : - • The CUSTOMER retains no copies • The CUSTOMER transfers all of the Software Product ( including all component parts , the media and printed materials , any upgrades , this EULA and , if applicable , the Certificate of Authenticity ) • The recipient agrees to the terms of this EULA . If the Software Product is an upgrade , any transfer must include all prior versions of the Software Product . � Termination The EULA granted herein shall remain in effect for an unlimited period unless the CUSTOMER fails to comply with any provision of this EULA . In which case , 3D perception AS has the right to terminate this license after having requested the CUSTOMER in writing to cure the failure and the CUSTOMER failed to do so within thirty ( 30 ) days of such notice . Upon termination the CUSTOMER shall return the Software Product and destroy all copies of the Software Product , including modified and adapted copies , if any . ii Page: 3 3D perception CompactControl and CompactDesigner G00047 User Manual Limited Warranty � Defects in Material and Workmanship 3D perception AS warrants that : - • The Software Product will perform substantially in accordance with the accompanying written material for a period of ninety ( 90 ) days from the date of receipt • Any hardware accompanying the Software Product will be free from defects in material and workmanship under normal use and service for a period of one ( 1 ) year from the date of receipt 3D perception AS and its suppliers ’ entire liabilit y and the CUSTOMERS exclusive remedy shall be repair or replacement of the Software Product or hardware that does not meet 3D perception AS ’ Limited Warranty and which is returned to 3D perception AS with a copy of the receipt . This Limited Warranty is void if failure of the Software Product or hardware has resulted from accident , abuse , or misapplication . Any replacement Software Product or hardware will be warranted for the remainder of the original warranty period or thirty ( 30 ) days , whichever is longer . � Other Warranties To the maximum extent permitted by applicable law , 3D perception AS and its suppliers disclaim all other warranties , either express or implied , including , but not limited to , implied warranties of merchantability and fitness for a particular purpose , with regard to the software product , and any accompanying hardware . This limited warranty gives the CUSTOMER specific legal rights . � Consequential Damages To the maximum extent permitted by applicable law , in no event shall 3D perception AS or its suppliers be liable for any special , incidental , indirect , or consequential damages whatsoever . This includes , without any limitation , damages for loss of business profits , business interruption , loss of business information , or any other pecuniary loss arising out of the use of or inability to use the Software product , even if 3D perception AS has been advised of the possibility of such damages . � Third Party Software Performance deterioration or damage to the Software Product and hardware caused or contributed to by a third - party software installed on the computer system without prior written authorisation of 3D perception AS shall render any and all warranties by 3D perception AS null and void . � Computer Viruses Performance deterioration or damage to the Software Product and hardware caused or contributed to by computer viruses shall render any and all warranties by 3D perception AS null and void . Applicable Law This EULA shall be governed by Norwegian law and shall benefit 3D perception AS . The CUSTOMERS consent to jurisdiction of the Kingdom of Norway is governed by the laws of Norway . Upgrades If the Software Product is an upgrade from another product , whether from 3D perception AS or another supplier , the CUSTOMER may use or transfer the Software Product only in conjunction with that upgraded product , unless the CUSTOMER destroys the upgraded product . If the Software Product is an upgrade of a 3D perception AS product , the CUSTOMER now may use that upgraded product only in accordance with this EULA . If the Software Product is an upgrade of a component of a package of software programs that the CUSTOMER licensed as a single product , then the Software Product may be used and transferred only as part of that single product package . After registering with 3D perception , and depending on the type of software license purchased , you will have either CompactControl or CompactDesigner loaded on your PC . CompactControl provides the user with full geometry , edge , gamma and colour control of projectors whereas CompactDesigner , as well as offering all that CompactControl offers , also facilitates the complete design of projection theatres along with in - depth analysis . This manual describes in detail the full range of all facilities offered by both CompactControl and CompactDesigner and clearly indicates any area that is only covered by CompactDesigner . About CompactControl CompactControl allows the user to set up a model of the actual theatre scenario by placing the appropriate combination of projectors , CompactUTM processors , Image sources and screen elements , in the theatre model at their correct physical locations . CompactControl then allows the user to perform geometry adjustment , edge blending , gamma correction and colour balancing in order to create a continuous picture with evenly distributed light intensity . However , if the device was switched on or reset after the program was started and the file was loaded , it may be necessary to send parameters to the device again .
